Abstract. In 1948,Canadian parliamentarians unanimously voted in favour of adopting criminal sexual psychopath legislation. An American invention that combined the force of the law with the curative abilities of psychiatry, sexual psychopath laws were the product of faith in science, and especially ";mental health,"; to solve social problems, combined with growing public anxiety about violent sexual assault, particularly against children. This mid-century medico-legal experiment has been well documented by American historians. Here, the Canadian response to the problem of ";sexual deviancy"; is examined, with particular reference to the Committee on the Sex Offender whose findings are representative of the range of ";expert"; opinion on this issue. Though the law itself was widely regarded as a failure, psychiatrists and other experts successfully claimed medical authority over certain types of sex offences, and popularized medical interpretations of sexual behaviour, including the pathologization of homosexuality.

Résumé. En 1958, les membres du Parlement canadien votaient à l'unanimité de l'adoption d'une loi sur les psychopathes sexuels criminels. Création américaine unissant force de loi et capacités curatives psychiatriques, les lois sur le concept de ";santé mentale"; pour résoudre les problèmes sociaux, et sur l'angoisse sans cesse croissante du grand public quant aux agressions sexuelles, principalement celles impliquant des enfants. Les historiens américains ont grandement fait état de cette initiative médico-légale amorcée au milieu du siècle. Ici, on étudie la réaction canadienne vis-à-vis la ";déviance sexuelle"; par l'entremise, notamment des conclusions du Comité sur les délinquants sexuels qui reflètent l'éventail des opinions ";d'experts"; en la matière. Bien que dans l'ensemble ladite loi ait été déclarée un échec, psychiatres et autres experts ont revendiqué avec succès une expertise médicale au niveau de certains types de délits sexuels, accordant ainsi une certaine notoriété aux interprétations médicales des comportements sexuels, y compris la désignation de l'homosexualité comme étant une forme de pathologie
